By accessing or using FitNest ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
FitNest is a fitness membership platform providing home workout programs, meal planning tools, macro tracking, and wellness calculators. The Service is intended for informational and personal fitness purposes only and does not constitute medical advice.
Always consult a qualified healthcare professional before starting any new fitness or nutrition program. FitNest does not provide medical advice, diagnosis, or treatment. Results vary by individual. If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention.
FitNest offers monthly and annual subscription plans. Subscriptions renew automatically until cancelled. You may cancel at any time through your account settings. Refunds are not provided for partial billing periods. Prices may change with 30 days notice.
New subscribers may receive a 7-day free trial. A credit card is required to start the trial. You will be charged the full subscription price ($19.99/month or $191.90/year) at the end of the 7-day trial period unless you cancel before it ends. You can cancel from your profile page at any time. Only one free trial per person.
You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to create an account. You agree not to share your account with others.
You agree not to misuse the Service, attempt to gain unauthorized access, reverse-engineer any part of the platform, or use the Service for any unlawful purpose.
All content on FitNest — including workout programs, meal plans, text, graphics, and software — is owned by FitNest and protected by copyright law. You may not copy, reproduce, or distribute any content without written permission.
You acknowledge that physical exercise involves inherent risks including but not limited to injury, disability, and death. You voluntarily assume all risks associated with using the workouts, meal plans, and fitness advice provided by FitNest. If you are postpartum, you must obtain clearance from your OB/GYN or healthcare provider before beginning any exercise program.
Results described on this site are not typical and individual results vary significantly based on factors including but not limited to starting fitness level, consistency, genetics, diet, medical conditions, and adherence to the program. Testimonials and examples reflect individual experiences and are not guarantees of outcomes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITNEST AND ITS OWNERS, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY. Our total liability shall not exceed the amount you paid in the 12 months prior to the claim.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FitNest does not warrant that the Service will be uninterrupted, error-free, or that any fitness results will be achieved.
You agree to indemnify and hold harmless FitNest and its owners, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.
If you believe content on FitNest infringes your copyright, contact us at support@trainwithfitnest.com with a description of the copyrighted work and the infringing material.
We reserve the right to suspend or terminate your account at any time, without notice, if we reasonably believe you are violating these Terms.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
